I fully understand that there is an inherent risk of injury during exercise, including, but not limited to, heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury. I understand that there is an inherent risk of injury during exercise. I further understand that I may injure myself as a result of my participation in The Functional Health Space exercise program. I knowingly and willingly hereby release The Functional Health Space from any liability now or in the future. I agree that my participation in physical exercise and activity is done at my own risk. This includes my participation in any activity, class, program or instruction conducted by The Functional Health Space. I agree that I am voluntarily participating in these activities and using these facilities, and assume all risk of injury, illness, damage or loss to my property that might result, including, without limitation, any loss or theft of any personal property.   

I agree on behalf of myself (and my minor child, personal representatives, heirs, executors, administrators, agents and assigns) to release and discharge The Functional Health Space (and its affiliates, employees, agents, representatives, successors and assigns) from any and all claims or causes of action, whether arising out of their negligence or not. This Waiver and Release of Liability includes, but is not limited to, injuries which may occur as a result of (a) my use of any exercise equipment or facilities which may malfunction or break; (b) The Functional Health Space improper maintenance of any exercise equipment or facilities, (c) The Functional Health Space negligent instruction or supervision, and (d) my slipping and falling while in the facilities or on the premises.  

I acknowledge that I have carefully read this Waiver and Release of Liability and understand that I am knowingly waiving and giving up any right that I may have to bring a legal action to assert a claim against The Functional Health Space (and its affiliates, employees, agents, representatives, successors and assigns), whether arising out of their negligence or not.

I acknowledge that all personal training sessions have a 24-hour late cancel policy and will be charged for that session
